By accessing or using The SCOTX Report (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.
You must be at least 18 years old and capable of forming a binding contract to create an account or otherwise agree to these Terms. By creating an account, you represent that you meet this requirement.
The SCOTX Report is a digest of the orders and opinions issued by the Supreme Court of Texas. We do not cover every order the Court issues: for example, we skip orders that merely rule on a motion to stay execution of a civil judgment, since those decide nothing about the underlying case—if the Court later actually decides that case, that decision is covered here in full. Case summaries, issue tags, and the "detailed breakdown" on each case page are generated using artificial intelligence and have not been reviewed by a licensed attorney or any other human before publication.
The SCOTX Report is an independent project. It is not affiliated with, endorsed by, or sponsored by the Supreme Court of Texas, any other court or government body, or any law firm.
Nothing on this Site is legal advice, and nothing about your use of this Site—including submitting a "flag" on a case page—creates an attorney-client relationship between you and The SCOTX Report, any person affiliated with it, or any firm. The Site is provided for general informational purposes for the Texas appellate bar and the public. You should not act, or decline to act, based on anything on this Site without seeking advice from a licensed attorney regarding your own particular situation.
AI-generated summaries can be wrong. They can misstate a holding, miss a nuance, omit a party's argument, or hallucinate a fact that does not appear anywhere in the underlying filings. Every case page links out to the official docket on search.txcourts.gov; that docket, and the underlying orders, opinions, and filings themselves—not this Site—are the authoritative record. Before relying on anything you read here in a filing, in advice to a client, or in any other professional capacity, verify it against the actual order, opinion, or docket entry.
If you notice an error, please use the "flag" button on the relevant case page (or contact us—see Section 19) so it can be corrected. We rely on readers catching mistakes we haven't caught ourselves.
This Site links extensively to search.txcourts.gov and other court-operated or government sites. We don't control those sites, don't host copies of the underlying documents ourselves, and aren't responsible for their availability, accuracy, or content.
Some case pages link to the Court's recording of the oral argument on the Court's YouTube channel, and some offer an "Oral argument transcript." We do not host the recordings. Each transcript is machine-generated from YouTube's automatic captions of the Court's recording, then corrected only for close misspellings of that case's own party, lawyer and Justice names and its terms of art. It is not a transcript prepared or certified by a court reporter or by the Court. It has no speaker names, it will contain errors, including in names, numbers, citations and legal terms, and it may omit or garble words altogether. Do not quote it, cite it, or rely on it. The recording itself, and any official transcript the Court or a court reporter prepares, is the record of what was said. Any summary of an oral argument on this Site is our own, written from that recording and transcript, and Section 5 applies to it in full. The Site is not affiliated with, endorsed by, or sponsored by the Supreme Court of Texas or YouTube.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING AS TO ACCURACY, RELIABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. We may update these Terms from time to time; the "Last updated" date above will reflect the most recent revision. Continued use of the Site after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will be administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Austin, Travis County, Texas, and governed by the Federal Arbitration Act. Arbitration will be conducted on an individual basis only—you and The SCOTX Report each waive any right to bring or participate in a class, collective, or representative action. Judgment on the arbitration award may be entered in any court having jurisdiction.
If any provision of these Terms is found unlawful, void, or unenforceable, that provision is severed from these Terms and does not affect the validity or enforceability of the remaining provisions.
These Terms, together with our Privacy Policy, make up the entire agreement between you and The SCOTX Report regarding the Site, and supersede any prior agreements or communications on the same subject.
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
